Title 12 › CHAPTER 13 — NATIONAL HOUSING › SUBCHAPTER V — MISCELLANEOUS › § 1735f–11
The Secretary must check at least once a year how often each mortgagee’s insured single-family loans go into early default or lead to insurance claims. The Secretary must compare each mortgagee’s early default and claim rates in every area where that mortgagee is allowed to make insured single-family loans with the rates of other mortgagees in the same area. Area = the geographic area where the mortgagee is authorized to originate insured single-family mortgages. If the comparison shows a mortgagee’s loans are an unacceptable risk to the insurance funds, the Secretary can end that mortgagee’s approval to originate or underwrite those loans. The Secretary must give at least 60 days’ written notice. The termination takes effect after the notice unless it is withdrawn or extended. If the mortgagee asks in writing within 30 days of the notice, it is entitled to an informal meeting to explain specific factors beyond its control that caused the high default and claim rates. The Secretary may rely on existing regulations already published.
