Title 12 › CHAPTER 23 — FARM CREDIT SYSTEM › SUBCHAPTER V — FARM CREDIT ADMINISTRATION ORGANIZATION › Part E — Farm Credit System Insurance Corporation › § 2277a–10
The Corporation can help troubled insured System banks by making loans, buying their assets or securities, taking on their debts, or giving money. It can do this to stop a bank from going into receivership, to get it back to normal, or to cut the risk to the Corporation when many banks or big banks face severe trouble. To help with mergers or sales between insured System banks, the Corporation can buy assets, assume debts, lend money, buy debt securities, guarantee against losses, or use any mix of those steps. The Corporation may not buy a bank’s stock. Any help it gives can be made junior to other creditors. Each year the Corporation must tell Congress how much it saved, or thinks it saved, by using these powers. Help must be the least costly option for the Farm Credit Insurance Fund compared with all other choices, including liquidating the bank. The Corporation must let other insured System banks provide relevant information before deciding. It must compare costs using present-value methods, write down its assumptions, and keep the records for at least 5 years. Cost comparisons are made as of the date the Corporation decides to help; liquidation costs are measured as of the date a conservator or receiver is appointed or the date help is decided. Before stand-alone help, the Corporation must check the bank’s management and approve any continuing directors or top officers. If the Corporation pays an owner of an insured obligation, it gets that owner’s rights to recover from the bank and to the same dividends. Any deal that lessens the Corporation’s rights in an asset is invalid unless it is written, signed at the time the bank got the asset, approved by the bank’s board or loan committee (in the minutes), and kept as an official bank record. “Insured System bank” includes production credit associations and other direct-lending associations under section 2279b. The Corporation could not use these powers during the 5-year period before January 1, 1993.
