The Corporation can refund any premium a System bank paid that was more than it owed. The Corporation can also sue a bank in court to collect unpaid premiums or to recover overpayments. Such suits must start within 5 years after the right to sue began. If a bank filed a false certified statement to avoid a premium, the 5-year period starts only when the Corporation discovers the fraud. If a bank fails to file a required certified statement (a required report) or to pay a premium and does not fix it within 30 days after the Corporation sends written notice to a bank officer, the bank will lose its rights, privileges, and charter under this law. The Corporation can sue where the bank is located. Any director who joined in the failure can be personally liable for resulting damages. These remedies are in addition to any others the Corporation may have.
