§3402 Access to Financial Records by Government Authorities Prohibited; Exceptions

Summary

Government officials may not get or copy a customer's financial records from a bank or other financial institution unless the records are clearly identified. Records can be released if the customer agrees under section 3404, or if there is an administrative subpoena or summons that follows section 3405, a search warrant under section 3406, a court (judicial) subpoena under section 3407, or a formal written request that meets section 3408. Other exceptions appear in sections 3403(c) and (d), 3413, and 3414.
