Title 12 › Chapter 38A— SINGLE FAMILY MORTGAGE FORECLOSURE › § 3761
Sale money must first pay certain foreclosure costs before anyone else gets paid. Those costs include advertising and postage for the required notices (under sections 3758 and 3760); mileage for posting notices and for the foreclosure commissioner’s or auctioneer’s attendance, measured by the most reasonable road distance (as provided in section 1821 of title 28); reasonable title and lien search costs; document recording costs; and a commission for the foreclosure commissioner if they are not a U.S. employee and the Secretary authorizes it.
