Title 12 › CHAPTER 46 — GOVERNMENT SPONSORED ENTERPRISES › SUBCHAPTER III — ENFORCEMENT PROVISIONS › § 4636a
The Director can stop or remove people from running or taking part in a regulated financial group or the Office of Finance. The Director can do this to any individual who is linked to the group or who is an officer, director, or manager, if the person broke laws, rules, final cease-and-desist orders, written conditions or agreements, acted in unsafe or unsound ways, or broke a duty to the group. The Director must also find that the group was harmed or likely to be harmed, or that the person gained money or benefit, and that the behavior involved personal dishonesty or showed a willful or ongoing disregard for the group’s safety. The Director gives written notice that explains the reasons and sets a hearing date. Hearings are set no earlier than 30 days and no later than 60 days after the notice, unless changed for good cause. If the person does not show up, they are treated as agreeing. Orders normally take effect when served, or in some cases 30 days after service, and a copy goes to the regulated group. A person under an order cannot run or take part in any regulated entity, solicit or transfer voting rights, break voting agreements, or serve as a director or officer. While the order runs, the person generally may not work for any regulated entity or the Office of Finance unless the Director gives written, public permission. Within 10 days after a suspension, the person may ask a federal court to pause the order. If a person is charged with a crime of dishonesty or breach of trust punishable by more than 1 year, the Director may suspend them until the charge is resolved; a conviction (or similar agreement) can lead to removal once final. If suspensions leave the board without a quorum, remaining directors act, and the Director can appoint temporary directors if all are suspended. The Director must decide hearing requests and outcomes within set 30- and 60-day rules and may write rules to carry out these powers.
