Title 12 › Chapter 51— SECURE AND FAIR ENFORCEMENT FOR MORTGAGE LICENSING › § 5106
The Bureau must build and run a system to register certain employees of banks, bank-owned subsidiaries, and Farm Credit institutions as loan originators in the Nationwide Mortgage Licensing System and Registry. The system must be in place by July 21, 2011. For each registrant the Bureau must give the Registry identifying information, including fingerprints for FBI and state criminal checks, and personal work history and experience, and must allow the Registry to get records of any government administrative, civil, or criminal findings. The Bureau must work with the Registry to give each registered loan originator a unique ID that lets people track employment history and public disciplinary or enforcement actions. The Registry must coordinate with the Bureau on registration functions and data rules. The Bureau may make very small exceptions to two specific rules in another part of the law, should try to use existing data to reduce burden, and should consider automating the process where practical.
