Requires the Council to watch for dangers to U.S. financial stability from big, connected banks, nonbank firms, or risks that come from outside the finance world. The Council must also work to prevent people from expecting government bailouts, and must act quickly against new threats. To do this, it gathers information from its member agencies, the Federal Insurance Office, and the Office of Financial Research (OFR), directs OFR work, and monitors markets and rule changes. It shares information across agencies, recommends supervisory priorities and stronger rules when needed, spots gaps in oversight, can identify key payment and clearing systems, and can recommend tougher standards for big firms. It also may comment on accounting rules, provide a place for members to discuss problems and settle jurisdiction fights, and must send an annual report to Congress about its work, market developments, threats, its formal decisions and recommendations, and ideas to improve market integrity and investor confidence. When the Council files its annual report, each voting member must send a signed statement saying either that enough is being done to reduce risks or what extra steps are needed. The Chair must testify at an annual Congressional hearing about the report. The Council may request data from OFR, member agencies, and the Federal Insurance Office and can require reports from U.S. or foreign bank holding companies and nonbank firms, coordinating with other regulators first. If information is still insufficient, the Council can ask the Board of Governors to examine a U.S. nonbank firm to decide if it needs supervision. All submitted data must be kept confidential, privilege claims are preserved, and Section 552 of title 5 (the Freedom of Information Act rules and exceptions) applies.
