The Bureau can make rules, orders, and guidance to enforce and carry out federal consumer financial laws. It must weigh the benefits and costs for consumers and companies, including whether a rule might reduce consumer access or affect people in rural areas. The Bureau must talk with other banking regulators before and during rulemaking, and if a regulator objects in writing the Bureau must explain that objection and its response when it adopts the rule. The Bureau can exempt whole classes of companies, service providers, or products when appropriate, after considering factors like total assets, transaction volume, and existing legal protections. Except for certain limits in other law, the Bureau has the main authority to write rules where both it and another agency could, and courts should give the Bureau the same deference as if it were the only agency applying those consumer financial laws (subject to section 5581(b)(5)(E)). The Bureau must watch markets for consumer risks and publish at least one report of important findings each year, starting with the first calendar year that begins at least 1 year after the designated transfer date. It can collect information from companies and require reports or written answers, but it cannot get a consumer’s personally identifiable financial records from a company unless the consumer gives written permission or another law allows it. The Bureau must protect confidential and proprietary information and may set registration rules for nonbank covered persons and share registration information to help consumers. For each major rule or order it adopts, the Bureau must assess how well the rule met its goals, ask for public comment on possible changes, and publish the assessment no later than 5 years after the rule took effect.
