Title 12 › CHAPTER 54 — STATE SMALL BUSINESS CREDIT INITIATIVE › § 5705
States can ask the Secretary to approve a state "other credit support" program so it can get federal money. The Secretary must approve the program if the State meets the three requirements in section 5704(b)(1)–(3), the program meets the eligibility rules below, the Secretary finds the program acceptable under extra considerations in the law, and the State filed a complete application with Treasury within 9 months after March 11, 2021. To be allowed, the program must show that $1 of public money will create $1 of new private credit; that all the State’s similar programs together can turn new federal funds into at least 10 times that amount in new small business loans; that any bank lenders using the program keep a meaningful amount of their own capital at risk; and that federal funds go to businesses averaging 500 employees or fewer (never over 750), to loans with an average principal of $5,000,000 or less (and never over $20,000,000). The Secretary will also look at expected benefits, the program’s management and capacity, its controls against loss or misuse, and the soundness of its plan. Approved programs get federal contributions according to the State’s allocation schedule, and the Secretary must set minimum program rules, using the capital access program rules as a guide when appropriate.
