The Bank must make rules to check whether any loan or financial guarantee is likely to hurt U.S. industries (including farming) or U.S. jobs by cutting demand for American-made goods or increasing imports. The Bank must ask the United States International Trade Commission for a report on how the Bank’s actions affect U.S. industries and employment. That report must look at past loans or guarantees and give recommendations about general areas that could harm domestic industries and jobs. After October 1, 1983, money may be appropriated as needed to carry out these rules. Before the Bank takes final action on a loan or guarantee, it must consider and answer in writing the views of people or groups who would be substantially harmed. That written-consideration rule does not require the Bank to follow subchapter II of chapter 5 of title 5.
