Title 12 › CHAPTER 6A — EXPORT-IMPORT BANK OF THE UNITED STATES › SUBCHAPTER I — GENERAL PROVISIONS › § 635a–3
When the Treasury Secretary learns that foreign government export loans or credits for sales to the United States go beyond limits set by prior international agreements, the Secretary must investigate right away. That investigation and any decision or authorization for the Export-Import Bank must be finished within 60 days of getting the information. If the Secretary finds such excess financing, they must ask the foreign export credit agency to withdraw it. If it is not withdrawn or there is no quick reply, the Secretary must tell the foreign country and everyone involved that the Export-Import Bank may be allowed to provide matching financing to competing U.S. sellers. The Secretary must authorize the Bank to offer guarantees, insurance, and credits to match the foreign offer unless the Secretary decides the foreign financing is unlikely to affect the sale or it has been withdrawn. If authorized, the Export-Import Bank may provide matching financing, but all loans, guarantees, and insurance must follow the Export-Import Bank Act of 1945.
