Title 14 › SUBTITLE II — PERSONNEL › CHAPTER 21 — PERSONNEL; OFFICERS › SUBCHAPTER I — APPOINTMENT AND PROMOTION › § 2130
Lets officers in the ranks of lieutenant (junior grade), lieutenant, lieutenant commander, commander, or captain get a temporary promotion to the next higher rank when they have a skill the Coast Guard badly needs and are working in a job meant for that higher rank. The Secretary decides which skills and jobs qualify. The President makes the appointments with the Senate’s approval, and a board picked by the Secretary must recommend the officer. These temporary promotions don’t count on the normal promotion list and do not change an officer’s permanent status or rights. If not declined, the appointment is treated as accepted and pay for the higher rank starts the day it is made. The promotion ends when the officer gets the permanent grade, leaves the job (unless they are on a promotion list), is found guilty of misconduct or poor performance, or when the Commandant decides it’s best to end it. The number of such positions is limited: lieutenant 0.5%, lieutenant commander 3.0%, commander 2.6%, captain 2.6%.
