The Commandant may let an officer above grade O–2 stay on active duty past their usual retirement date if the officer has a critical skill, specialty, or is in a career field the Commandant names. The Commandant must list which skills, specialties, and fields qualify and make a policy that explains the criteria. An officer kept on active duty this way must retire on the first day of the month after the month they complete 40 years of active service, unless they retired earlier.
