The Secretary must finish handling any application to correct military records under 10 U.S.C. 1552 within 10 months after getting the complete application. If the Coast Guard Board for Correction of Military Records gets a complete application and 10 months go by, the applicant’s administrative options are treated as used up. If the Board has issued a recommended decision, that decision becomes the final official action and cannot be reviewed further inside the department that runs the Coast Guard. If the Board has not issued a recommended decision, the applicant may get a court order under 5 U.S.C. 706(1) forcing final action within 30 days, and the department must pay the costs of getting that order, including a reasonable attorney’s fee, from amounts appropriated to that department.
