Title 14 › SUBTITLE II — PERSONNEL › CHAPTER 25 — PERSONNEL; GENERAL PROVISIONS › SUBCHAPTER I — GENERAL PROVISIONS › § 2514
Lets the Commandant run a program that lets Coast Guard members temporarily leave active duty for up to 3 years to meet personal or work needs and then return to active duty. Members must sign a written agreement to join the Coast Guard Ready Reserve while away, do required inactive training to keep skills and fitness, and serve 30 days on active duty for each month they were away. The Commandant can set rules for release and can order a member back to active duty. While in the program a member gets basic pay equal to two‑thirtieths of the monthly basic pay they would have had under section 204 of title 37. Special or incentive pays or bonuses stop during the program but agreements for them may be revived when the member returns, if the pay is still authorized and the member meets eligibility; repayment rules apply if the member becomes ineligible. Members may get travel allowances to move to and from one residence under section 474 of title 37, and may carry up to 60 days of leave forward under section 701 of title 10. Service by a Reserve officer during the program is excluded from computing total years of service under section 14706(a) of title 10, and time in the program does not count toward retirement eligibility or retired/retainer pay under chapters 841, 1223, or 71 of title 10 as stated in the law. Officers and enlisted members are not eligible for promotion or advancement while in the program. On return, the Commandant may adjust an officer’s date of rank and the officer becomes eligible for promotion along with peers; enlisted members become eligible again when they meet time‑in‑grade and other rules set by the Commandant. While participating, a member is treated as on active duty for more than 30 days for medical and dental care (chapter 55, title 10), disability retirement/separation (chapter 61, title 10 and chapters 21 and 23 of this title), death benefits (subchapter II of chapter 75, title 10), family travel for burial (section 453(f), title 37), VA benefits (part II, title 38), and, for victims of alleged sex‑related offenses (section 1044e(h), title 10), access to Coast Guard behavioral health, sexual assault resources, and legal help including special victims’ counsel as practicable.
