When a Reserve officer is promoted to the next higher grade, their rank date is the day they are appointed to that grade. If the promotion uses a running mate system, the officer gets the same rank date as their running mate. The officer must be paid at the higher grade for duty performed from that appointment date. If an inactive-duty promotion list officer is promoted under a running mate system to rear admiral or rear admiral (lower half), and the officer is acceptable to the President and the Senate, the promotion must occur no later than the date their running mate is promoted, unless subsection (c) applies. The appointment date is the day the Secretary exercises promotion authority. The Secretary may change that date if a required finding under section 3745(a) was delayed for reasons beyond the officer’s control and the officer is otherwise qualified, or for any other reason fairness requires.
