The Secretary can set up a retention board to reduce the number of Reserve officers on active status in a grade so promotions can move up or because there are too many officers in that grade. The board reviews active Reserve officers in that grade who have 18 or more years of service to decide about retirement. It will not review officers who are on extended active duty, are on a promotion select list, will reach 30 years of commissioned service by the June 30 after the board starts, or are age 59 or older when the board starts. The board must, when possible, be at least 50% Reserve officers, be made up of officers senior to those being reviewed, and, when possible, avoid using members who served on the last board for that grade. If an officer is not recommended to stay on active status, they can be offered transfer to the Retired Reserve if eligible; otherwise the Secretary may move them to the inactive list or discharge them on the June 30 after the board’s report is approved. Transfers follow section 12646 of title 10, and rules in section 2117 apply unless they conflict with this rule.
