§3756 Grade on Entry Upon Active Duty

Summary
When a Reserve officer is sent to active duty or to active-duty training, they must serve at the rank they already have. The Secretary can allow them to serve at a higher rank if approved.

A Reserve officer ordered to active duty or active duty for training shall be ordered in the grade held; except that the Secretary may authorize a higher grade.
