Title 15 › Chapter 36— CIGARETTE LABELING AND ADVERTISING › § 1332
Defines key words used in the chapter. “Cigarette” means a roll of tobacco wrapped in paper or another non-tobacco cover, and also rolls wrapped in tobacco-containing material if they look like the paper-wrapped kind. “Commerce” means trade or movement of goods that crosses borders of the States or the listed U.S. territories, goes between points in a State or the listed territories through places outside them, or stays entirely within certain territories (District of Columbia, Puerto Rico, Guam, the Virgin Islands, American Samoa, Wake Island, Midway Islands, Kingman Reef, Johnston Island). “United States” in a place sense includes the several States, the District of Columbia, and those same territories; “State” also includes any political division of a State. “Package” means any pack, box, carton, or container used to sell or give out cigarettes. “Person” means an individual, partnership, corporation, or other business or legal entity. “Sale or distribution” includes free samples or other giveaways. “Little cigar” means a tobacco roll wrapped in leaf or tobacco-containing wrapper (not a cigarette) where 1,000 units weigh no more than three pounds. “Brand style” means a cigarette variety defined by its tobacco, tar or nicotine levels, flavoring, size, filter, or packaging. “Secretary” means the Secretary of Health and Human Services.
