Title 15 › Chapter 37— STATE TECHNICAL SERVICES › § 1355
The Secretary must not accept a State's five-year plan unless the Governor or the Governor's designee certifies that the plan matches the State's policies and goals. The Secretary also must not accept an annual technical services program unless the Governor certifies that the agency in charge has met several requirements. The agency must have invited all qualified institutions to apply, coordinated with other States and public programs, set rules so state workers get no extra outside pay or have conflicts of interest, arranged matching non-Federal funds, confirmed the services are not already readily available privately, avoided work just for one firm unless it helps the wider community or region, and made all reports public or available at cost.
