Title 15 › CHAPTER 40 — DEPARTMENT OF COMMERCE › § 1511d
Create a Chesapeake Bay Office inside the National Oceanic and Atmospheric Administration (NOAA). The Secretary of Commerce must pick a Director, after talking with the Chesapeake Executive Council, who has experience with Chesapeake Bay science or resource work. The Director can hire staff as needed. The Office must help federal, state, and local agencies by giving technical help on how the Bay works, on ways to restore and protect living things and their habitats, and on tracking whether management plans are working. The Office must make and carry out a NOAA strategy that ties together NOAA’s science, monitoring, data, rules, and management to help the Chesapeake Bay Program meet its agreement goals. The Office must coordinate NOAA programs (including research, fisheries work, data, remote sensing, coastal management, habitat restoration, invasive species, disease, and ecosystem health) with EPA and other agencies, require proper peer review of projects, share research results, and send a report every two years to Congress and the Secretary. That report must list needed research and monitoring and propose continued NOAA actions that fit with the Chesapeake 2000 agreement and later agreements. The Director, with the Chesapeake Executive Council, must run a community-based small grants and technical help program in the Bay watershed. Grants can pay up to 75% of project costs for things like fixing fish passages, building reefs, restoring wetlands or seagrass, producing oysters for restoration, and fighting nonnative species. Eligible recipients include local governments, the District of Columbia, and certain tax-exempt organizations working with a local government. The Director can set extra rules for the program. The Chesapeake Executive Council means the representatives from Virginia, Maryland, Pennsylvania, EPA, the District of Columbia, and the Chesapeake Bay Commission (and any future signers). Congress authorized $6,000,000 per year for fiscal years 2002 through 2006 for the Office.
