Title 15 › Chapter 40— DEPARTMENT OF COMMERCE › § 1521a
Creates a Department of Commerce Nonrecurring Expenses Fund in the U.S. Treasury. Unused balances from expired Commerce discretionary appropriations from the Treasury’s General Fund can be moved into this Fund, but only up to the end of the fifth fiscal year after those funds were last available. Money in the Fund can be used until spent for IT and facilities upgrades needed to run the Department, with OMB approval. The Department must tell the House and Senate Appropriations Committees at least 15 days before it plans to use the money. Separately, $20,000,000 is added to the Fund for a business application system modernization. That $20,000,000 is available until September 30, 2022.
