Title 15 › CHAPTER 47 — CONSUMER PRODUCT SAFETY › § 2055a
Requires the Consumer Product Safety Commission to create and run a public, searchable online database about the safety of consumer products and other items it regulates, if money is available. The Commission had to send Congress a detailed plan within 180 days after August 14, 2008, and must launch the database within 18 months after sending that plan. The site must be on the Commission’s website and easy to search. The database must include reports of injury, illness, death, or risk from consumers, government agencies, health care workers, child service providers, and public safety groups, plus notices about voluntary fixes and any manufacturer comments the Commission accepts. People can send reports by electronic, phone, or paper methods. Each report must include a description of the product, the maker or private labeler, what happened, contact information for the reporter, and a statement that the report is true to the reporter’s knowledge and that the reporter agrees to publish it. The Commission must try to send each complete report to the named manufacturer within 5 business days. Reports should be posted no later than the 10th business day after that transmission, or on the 15th business day if the Commission must get a model or serial number or photo first. The Commission may redraft or remove trade secrets or other protected business information, and manufacturers can ask a court in certain federal districts to seek removal of non‑protected material. The site must warn users it does not guarantee accuracy. The Commission must send Congress an annual report about the database and, within 2 years of launch, the Comptroller General must study how useful the database is and recommend ways to increase public use.
