§2642 Definitions

Summary

Gives plain meanings for important words used in this subchapter. An accredited asbestos contractor is a person accredited under section 2646 of this title. Administrator means the Administrator of the Environmental Protection Agency. Asbestos means six specific minerals: chrysotile, crocidolite, amosite, anthophyllite, tremolite, and actinolite. Asbestos-containing material is any material with more than 1 percent asbestos by weight. The EPA document titled "Guidance for Controlling Asbestos-Containing Material in Buildings" means the version in effect on March 31, 1986; the "most current guidance document" means that guidance as EPA changed it after March 31, 1986. Friable asbestos-containing material is material that, when dry, can be crumbled, powdered, or reduced to dust by hand pressure, and it also includes material that becomes damaged so it can be crumbled that way. Local educational agency covers the local education agency in section 7801 of title 20, owners of private nonprofit elementary or secondary school buildings, and the governing authority of schools under the Defense Dependents' Education Act of 1978 (20 U.S.C. 921 et seq.). Non-profit elementary or secondary school is a school defined in section 7801 of title 20 owned and run by nonprofit groups whose earnings do not benefit private individuals. Public and commercial building means any building that is not a school building, except it does not include a residential apartment building with fewer than 10 units. Response action means ways to protect health and the environment from asbestos-containing materials, including methods in chapters 3 and 5 of the EPA guidance. School means an elementary or secondary school as defined in section 7801 of title 20. School building means any classroom-ready structure or related facility (labs, libraries, cafeterias, gyms, admin, maintenance, storage, utility areas, and necessary hallways). State includes a State, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Northern Marianas, the Trust Territory of the Pacific Islands, and the Virgin Islands.
