Local school districts may not do certain work in a school until the district has filed a management plan that the Governor has not disapproved by the end of the review period under section 2645. While waiting, the district cannot do renovations or remove building materials (except emergency repairs) unless the school is using a grant under section 4014 of title 20, or an inspection under the rules in section 2643 has been done and the district follows 40 CFR 763.90(g), (h), and (i) and Appendix D to subpart E of part 763 for response actions and waste transport/disposal. The district also may not do operations and maintenance work unless it follows 40 CFR 763.91 (including appendix B to subpart E) and 763.92(a)(2). Any school employee ordered to do emergency repairs involving known or suspected asbestos, or to do operations and maintenance, must be given proper training, proper equipment, and allowed to use safe work practices to prevent asbestos exposure. An "emergency repair" means an unplanned fix after a sudden event that threatens people’s health or safety or the building’s structure.
