§3610 Relationship of Statutory Provisions to State and Local Laws

Summary

States and local governments can make and enforce laws about condominiums, cooperatives, and conversion projects as long as those laws do not weaken the consumer protection standards in this chapter. They are free to pass local rules, ordinances, or codes on those topics if the rules do not conflict with the chapter’s consumer protections. But if a state or local government with the power to do so passed a law within the three-year period following October 8, 1980, saying the chapter’s provisions do not apply there, then the chapter’s rules won’t apply in that place. The exception is that section 3608 still applies, and the part of section 3609 about leases connected to claims under section 3608 also still applies.
