Title 15 › Chapter 70— COMPREHENSIVE SMOKELESS TOBACCO HEALTH EDUCATION › § 4404
Violating section 4402 or the FTC rules made for it is treated the same as violating section 45. A person who breaks section 4402 or 4403(a) is guilty of a misdemeanor and, if convicted, can be fined up to $10,000. The FTC must issue the 4402 rules under section 553 of title 5 and had to create them within 180 days after February 27, 1986. Aside from the duties in 4402 and 4403, nothing here changes the FTC’s power over unfair or deceptive advertising of smokeless tobacco.
