§4408 Definitions

Defines key words used in the chapter. Smokeless tobacco — means the term as defined in section 387(18) of title 21. Commerce — covers three kinds of trade: (A) between any State, the District of Columbia, the Commonwealth of Puerto Rico, Guam, the Virgin Islands, American Samoa, Wake Island, Midway Islands, Kingman Reef, or Johnston Island and places outside them; (B) between points in any State or those listed places when the route goes through places outside them; and (C) entirely within the District of Columbia or those listed territories. United States (geographical) — includes the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, the Virgin Islands, American Samoa, Wake Island, Midway Islands, Kingman Reef, Johnston Island, and Armed Forces installations. Package — any pack, box, carton, pouch, or container used to offer, sell, or give smokeless tobacco to consumers. Sale or distribution — includes sampling or any distribution not for sale. Secretary — means the Secretary of Health and Human Services.
