Title 15 › CHAPTER 2 — FEDERAL TRADE COMMISSION; PROMOTION OF EXPORT TRADE AND PREVENTION OF UNFAIR METHODS OF COMPETITION › SUBCHAPTER I — FEDERAL TRADE COMMISSION › § 45g
Online dating sites must tell a member when someone who sent or got a message from them has been banned for suspected fraud. The notice must say the banned person’s username or profile ID and the last time they exchanged a message. The notice must also say the banned person might have used a fake identity or tried to scam people, warn members not to send money or personal financial information, offer tips to avoid fraud (for example by linking to another page), and give the service’s customer‑service contact. The notice must be clear and easy to see and must be sent by email, text, or another agreed way. The site must send the notice within 24 hours after the ban starts, but may wait up to 3 days if it thinks a delay is needed. If law enforcement asks for a delay because of an investigation, the site must not send the notice while the delay lasts and must send it within 3 days after the delay ends. A site is not liable for following these notice rules. The Federal Trade Commission (the Commission) will enforce these rules with the same powers and penalties it already has. A State attorney general or other state consumer officer may sue for harms to residents, but they must notify the Commission before filing and the Commission may join the case. If the Commission already sued the same defendant, a State cannot bring a case against that defendant while the federal case is pending. States may not make their own different rules about when or how these notices must be sent, though state contract and tort laws still apply. Key terms: banned member = a person whose account or profile is suspended or ended for a fraud risk; Commission = Federal Trade Commission; fraud ban = suspension or termination for a significant risk of trying to get money by fraud; member = someone allowed to set up an account or profile; online dating service = a website or app that helps members meet for dating or romance; online dating service provider = the business that offers the service; State = each state, DC, territories, possessions, and federally recognized Indian Tribes. These rules take effect 1 year after October 20, 2026.
