Title 15 › CHAPTER 14B — SMALL BUSINESS INVESTMENT PROGRAM › SUBCHAPTER III — INVESTMENT DIVISION PROGRAMS › Part A — Small Business Investment Companies › § 687e
The Administrator can remove, suspend, or bar from management any "management official" — meaning an officer, director, partner, manager, employee, agent, or other person who helps run a licensee — if the person knowingly and willfully commits a serious violation of the law or rules, or knowingly breaks a management duty in a way that shows personal dishonesty. The Administrator must give a written notice saying the facts and a time and place for a hearing. The hearing must be set not earlier than 30 days and not later than 60 days after the notice unless the official or the Attorney General asks for a different date. If the official does not show up or send a representative, they are treated as if they agreed to removal. If the grounds are proved or the official consents, the Administrator may order removal. A removal order usually takes effect 30 days after it is served on the licensee and the official, unless the order itself says otherwise. Orders stay in force unless the Administrator or a court changes them. The Administrator may also suspend or bar an official right away if needed to protect the licensee or the Administration. That suspension starts when the notice is served and lasts while removal proceedings go on, unless a court stays it. An official can ask a federal district court for a stay within 10 days. If a U.S. attorney files criminal felony charges for dishonesty or breach of trust, the Administrator may suspend the official until those charges are finally resolved. A final criminal conviction can lead to removal once it is no longer subject to appeal. Copies of all notices to the official must also be served on the licensee. Hearings are held where the licensee’s main office is unless the parties agree otherwise and follow chapter 5 of title 5. After a hearing, the Administrator must issue a decision within 90 days after saying the case is ready for final decision. A party can ask the appropriate U.S. court of appeals for review within 30 days of the order being served. Asking for court review does not automatically pause the Administrator’s order unless the court orders a stay.
