Title 15 › CHAPTER 14B — SMALL BUSINESS INVESTMENT PROGRAM › SUBCHAPTER IV–A — GUARANTEES › Part A — Commercial or Industrial Lease and Qualified Contract Guarantees › § 694–1
Lets the Administration guarantee payments under certain contracts when small businesses are at a financing or competitive disadvantage in planning, designing, or installing pollution control facilities. The guarantee can cover rentals or other amounts under leases, loans, installment sales, or similar deals with a small business. The Administration may make guarantees directly or together with a surety or other company. Definitions: "pollution control facilities" — property the Administration finds will help prevent or treat pollution or waste; "person" — includes companies, governments, and individuals; "qualified contract" — a lease, loan, installment sale, or similar agreement with a small business. Rules: The Administration must issue a guarantee even if the property was bought with proceeds of industrial revenue bonds whose interest is tax-exempt. Each guarantee must cover the full amount due and is backed by the full faith and credit of the United States. The Administration will only guarantee when it reasonably expects the small business will meet the contract terms. The Administration sets a uniform annual fee for guarantees, reviewed periodically, that must be at least 1% and no more than 3.5% per year of the minimum annual guaranteed rental. The Administration can also charge processing fees and may require escrow payments (up to one-fourth of the average yearly payments), steps to limit losses on default, assignment only with permission, and other reasonable conditions. Section 693 applies to how this is run.
