Title 15 › CHAPTER 2 — FEDERAL TRADE COMMISSION; PROMOTION OF EXPORT TRADE AND PREVENTION OF UNFAIR METHODS OF COMPETITION › SUBCHAPTER V — TEXTILE FIBER PRODUCTS IDENTIFICATION › § 70a
It is illegal to make, import, ship, sell, advertise, or offer for sale any textile fiber product that is mislabeled or falsely advertised. Doing those things counts as an unfair and deceptive business practice that the Federal Trade Commission can act against. There are some exceptions. Ordinary carriers and freight handlers are not liable when they just move goods. Processors or finishers doing contract work are not liable if they do not change the fiber content against the contract. Goods made only for export are excluded. Publishers and ad agencies are not normally liable, but the maker, distributor, or seller who put out the false ad is. If the FTC asks, a publisher or ad agent must give the name and address of that responsible U.S. person. Unfinished products not yet made in the form for the final buyer are exempt if they come with an invoice or paper that correctly shows the same information that would be required on a label and the name and address of the issuer.
