Illegal oil sent across state lines in violation of the law can be seized by a United States district court and taken by the federal government. The government brings a forfeiture suit in the court, using procedures like maritime in rem cases, but either side can ask for a jury on facts. The court may return the oil to its owner if keeping it would cause undue hardship. Any oil the government keeps will be handled under rules the President makes. If the owner (not the shipper) holds a certificate of clearance that looks valid and was issued by a board under section 715d saying the shipment is not illegal, and the owner had no reasonable reason to doubt it, then the oil cannot be forfeited.
