Title 15 › CHAPTER 15B — NATURAL GAS › § 717c
Natural-gas companies must charge fair and reasonable prices for gas they sell or move under the Commission’s control. They cannot give unfair advantages to some people, places, or types of service, or keep unreasonable differences in rates, service, or facilities. Companies must file and keep open for the public schedules that show all rates, charges, rules, practices, and contracts. The Commission decides the form and timing of those filings (the law called for at least sixty days from June 21, 1938). Companies may not change a rate, rule, or contract except after thirty days’ notice to the Commission and the public, unless the Commission allows a sooner change for good cause. The Commission can hold quick hearings on any new schedule, suspend a change for up to five months while it studies the matter, and after full hearings order refunds (with interest), require a bond, and demand detailed accounts if an increase is later found unjustified. The company seeking a higher rate must prove the increase is fair, and the Commission must handle such cases quickly. The Commission may allow market-based rates for new storage capacity placed in service after August 8, 2005, even if the company cannot show it lacks market power, if the Commission finds those rates are needed to encourage the storage project and customers are protected. The Commission must set reasonable consumer protections and must review such market-based rates from time to time to make sure they remain fair and not unfairly discriminatory.
