Title 15 › Chapter 103— CONTROLLING THE ASSAULT OF NON-SOLICITED PORNOGRAPHY AND MARKETING › § 7705
It is illegal for a person to promote or allow promotion of their business, goods, property, or services in a commercial email if that email was sent in violation of section 7704(a)(1) and three things are true: the person knew or should have known the items were being promoted in that email; the person received or expected to receive an economic benefit from the promotion; and the person did not take reasonable steps to stop the email or to detect it and report it to the Commission. A supplier that simply provides goods or services to the promoter is usually not liable, unless the supplier owns more than 50 percent of the promoter’s business or has actual knowledge that the items are being promoted in a violating email and receives or expects an economic benefit. Parts (f) and (g) of section 7706 do not apply to violations here, and, except for the limited rule in 7706(f)(8), this does not stop other actions under the same chapter.
