§7710 Improving Enforcement by Providing Rewards for Information About Violations; Labeling

Summary

The Commission must send two reports to the Senate Committee on Commerce, Science, and Transportation and the House Committee on Energy and Commerce. The first report, due within 9 months after December 16, 2003, must describe a whistleblower reward system. It must include rules to pay at least 20 percent of the total civil penalty to the first person who both names the violator and gives information that leads to the Commission collecting a civil penalty. It must also include ways to make filing complaints easier, including allowing complaints to be sent electronically. The second report, due within 18 months after December 16, 2003, must present a plan to make commercial email clearly identifiable from its subject line—by following Internet Engineering Task Force standards, using the characters ADV in the subject line, or another similar marker—or explain any concerns that would make the Commission oppose the plan.
