The duties in sections 77jjj through 77qqq that apply to any person must be part of every qualified indenture and take priority over any clause that tries to limit or conflict with them. An indenture may also include other provisions, as long as they do not conflict with the rest of the subchapter. Those duties apply to indentures made in the past and to ones made in the future, and they are treated as if they change or replace inconsistent terms in earlier indentures. That rule does not force old indentures to include the optional items listed in 77jjj(b)(1), 77kkk(b), 77nnn(d), 77ooo(a), 77ooo(b), 77ooo(d), 77ooo(e), or 77ppp(a)(1).
