Title 15 › CHAPTER 2A — SECURITIES AND TRUST INDENTURES › SUBCHAPTER III — TRUST INDENTURES › § 77uuu
The Commission can investigate and gather evidence to enforce this law. Its members or designated officers can make people swear to tell the truth, order witnesses to appear, take testimony, and demand books, papers, contracts, and other records the Commission thinks are relevant. These orders can reach people and records anywhere in the United States or U.S. territories and can require them to appear where the Commission sets for an investigation or hearing. The Commission also may use other investigation and enforcement powers given in sections 77t and 77v(b) and (c). Federal banking agencies (the Treasury, Comptroller of the Currency, Board of Governors of the Federal Reserve, Federal Reserve Banks, and FDIC) may, under rules they set, give the Commission reports and exam results about trustees or people who want to be trustees. A trustee or prospective trustee must agree, before an indenture is qualified, that such exam reports can be given to the Commission. Those reports and related correspondence must be kept confidential inside the Commission, except the Commission may share them confidentially with the U.S. Attorney General if needed. Investigations of prospective trustees are limited to checking eligibility and including required eligibility information and the most recent published report of condition under section 77jjj. The Commission may hire staff, set their pay, and lease or use property as allowed by section 78d(b).
