Title 15 › CHAPTER 2D — INVESTMENT COMPANIES AND ADVISERS › SUBCHAPTER II — INVESTMENT ADVISERS › § 80b–10a
Federal banking agencies must give the SEC any exam results, reports, records, or other information about investment-adviser activities of banks, bank holding companies, savings and loan holding companies, or separately identifiable bank departments or divisions that are registered under section 80b–3 when the SEC asks. The SEC must also give the same kind of information to the appropriate federal banking agency on request. This rule covers those firms and their registered subsidiaries or departments. They do not have to release the shared information to others, but they may still give it to Congress, other federal agencies, self‑regulatory organizations acting within their authority, or if a U.S. court orders it in a case brought by the United States, the SEC, or the agencies. For purposes of the Freedom of Information Act (5 U.S.C. 552), this is treated as a statute listed in subsection (b)(3)(B). "Appropriate Federal banking agency" has the meaning in section 1813 of title 12 and nothing here limits any other legal powers the agency has over those banks or affiliates.
