Title 15 › CHAPTER 107 — PROTECTION OF INTELLECTUAL PROPERTY RIGHTS › SUBCHAPTER I — COORDINATION AND STRATEGIC PLANNING OF FEDERAL EFFORT AGAINST COUNTERFEITING AND INFRINGEMENT › § 8113
Requires the IPEC to create and update a Joint Strategic Plan to fight counterfeiting and other intellectual property crimes. The plan must aim to cut counterfeit goods in U.S. and global supply chains, find and fix weak spots or duplicated work across federal agencies, share information as allowed by law and Department of Justice rules to help arrest and prosecute offenders, disrupt criminal networks, and help other countries improve their enforcement and agree on international rules. The plan must be finished within 12 months after October 13, 2008, and again every three years by December 31. The IPEC must post the plan on the White House website and send it to the Senate and House Judiciary and Appropriations Committees. The IPEC must run the planning process, coordinate agency meetings, and can consult private experts. Agency leaders must assign experienced staff and share relevant enforcement data with IPEC as allowed by law. Each plan must list priorities, how the government will carry them out, resource needs, next-year performance measures, an analysis of economic and health threats from IP violations, which agencies will do each task, and how agencies will coordinate and be held accountable. The plan must also include programs to train and help foreign governments, aim to use federal resources efficiently, focus on countries where help will best protect U.S. interests (guided by the U.S. Trade Representative’s list under 19 U.S.C. 2242(a)), and set metrics to measure results.
