The SEC can make rules to define terms, including “commercial risk”; other terms added to the Securities Exchange Act of 1934 by this subtitle; and the terms “security-based swap,” “security-based swap dealer,” “major security-based swap participant,” and “eligible contract participant,” to include transactions or entities set up to avoid this subtitle.
