The Secretary must hold a vote of eligible manufacturers during the 60 days before a proposed order would start. The order only takes effect if more than half of the manufacturers who vote approve it and those yes votes also represent more than half of the machine cavities in use by the voting manufacturers. Each manufacturer gets one vote and can vote only if it made concrete masonry products for at least 180 days before voting starts. The Secretary decides how the vote works. Manufacturers who want to vote must register after the Secretary gives notice at least 30 days before voting. Ballots and anything that could show who voted are kept strictly confidential. Later votes can be held if the Board asks, or if 25% or more of eligible voters ask starting 5 years after approval and every 5 years after that. If a later vote favors stopping or ending the order by the same majority rule, the Secretary must stop collecting assessments within 180 days and suspend or end programs as soon as possible and in an orderly way. The Board must repay the Secretary for the referendum costs from assessments.
