The Secretary can fine someone up to $10,000 for each violation of this part, but the person must be given notice and a chance for a hearing first. Each illegal taking or import is a separate violation. The Secretary can reduce or cancel a fine for a good reason. If the fine is not paid, the Secretary can ask the Attorney General to sue in federal district court where the person is found, lives, or does business to collect it (unless section 1387 applies). If a person imports a marine mammal or product only for personal or family use (not to help others or to sell), the Secretary may let them give it up to the enforcement officer at the port instead of starting a penalty case. If someone knowingly breaks these rules, they can be convicted and fined up to $20,000 for each violation, jailed for up to one year, or both (unless section 1387 applies).
