Title 16 › CHAPTER 31 — MARINE MAMMAL PROTECTION › SUBCHAPTER V — MARINE MAMMAL HEALTH AND STRANDING RESPONSE › § 1421a
Require the Secretary to make clear rules and gather information about sick, injured, or stranded marine mammals. The Secretary must work with the Interior Department, the Marine Mammal Commission, and marine experts (including people in stranding networks) to create science-based criteria for when a rehabilitated marine mammal can be released back to the wild. The Secretary must also collect and update information on rescue and rehab practices, how tissues are collected and tested, relevant scientific literature, records of strandings and entanglements (including unusual mortality events), and other life-history and tissue data. After each response to a stranding or entanglement, the Secretary must collect data from responding NOAA or Fish and Wildlife staff and require stranding network responders to submit data, including NOAA Form 89–864 (OMB #0648–0178), NOAA Form 89–878 (OMB #0648–0178), supplemental field information (weather, behavior, health, samples, etc.), and lab results (histopathology, toxicology, microbiology, virology, parasitology). Responders must send basic event forms within 30 days, supplemental field data within 30 days of availability, and lab results within 30 days of the lab report. The Secretary must build an online input system with NOAA leadership, the stranding network, and the GSA Office of Evaluation Sciences. Data must be shared to improve responses, public health alerts, research, publications, and education. NOAA/FWS staff data must go public through Health MAP and the Observation System within 30 days. Responder-submitted data must be public after 2 years, unless the responder gives written permission for earlier release or data are withheld for law enforcement or legal reasons. The Secretary must publish and update uniform data standards, work with regional networks on data management and outreach, set rules for crediting users of the data, and cannot force submission of research data not listed above.
