Title 16 › Chapter 32— MARINE SANCTUARIES › § 1435
Regulations for marine sanctuaries must follow commonly accepted international law and any treaties or agreements the United States has signed. Those rules cannot be used against people who are not U.S. citizens, U.S. nationals, or U.S. resident aliens unless international law allows it or there is an agreement with the person’s country or, for ship crew, with the country whose flag the ship flies. The Secretary of State, working with the Secretary, must negotiate with other countries to protect national marine sanctuaries. The Secretary, together with the Secretary of State and other federal agencies, must work with foreign governments and international groups to protect and manage special marine areas under regional and multilateral arrangements.
