Title 16 › CHAPTER 38 — FISHERY CONSERVATION AND MANAGEMENT › SUBCHAPTER V — FISHERY MONITORING AND RESEARCH › § 1883
Start an independent scientific review within 30 days of October 11, 1996 to check whether the catch and effort numbers for Gulf of Mexico red snapper are accurate and complete for commercial, recreational, and charter fishing; whether the science, methods, and models used to judge the stock and guide the management plan are appropriate; whether the management measures protect and manage the stock properly; and what the costs and benefits are of reasonable alternatives to a limited access privilege or individual quota program. Commercial, recreational, and charter fishermen must be allowed to take part in the review and give information without being punished for past failures to report. The Secretary must send a detailed written report of the review to the Gulf Council within one year of October 11, 1996. The Gulf Council may not create or keep preparing any plan before October 1, 2002 that would set up an individual fishing quota program or allow consolidation of licenses that causes different trip limits for vessels in the same class. On or after October 1, 2002, the Council may only prepare or submit such a plan if two referendums approve it. The Secretary will run those votes when the Council asks. Only people who held a vessel permit with a red snapper endorsement on September 1, 1996 (or who received such a permit later) and captains who fished commercially with that endorsement in every red snapper season from January 1, 1993 to September 1, 1996 may vote. Votes are weighted by how much each permit or captain caught between January 1, 1993 and September 1, 1996, and a simple majority wins. Before each vote, the Secretary must identify and notify eligible voters and provide details about the vote and the proposed plan. Any plan sent by the Council after October 11, 1996 must set separate quotas for recreational (including charter) and commercial fishing that close retention for that sector for the rest of the fishing year when its quota is reached, and the quotas must match the sector allocations and not include harvests beyond those allocations.
