The Secretary must appoint a Senate‑confirmed senior NOAA official, after consulting the Under Secretary for Oceans and Atmosphere, to handle international fisheries agreements, make policy, and serve as U.S. Commissioner. That official will advise senior Commerce and NOAA leaders, with the Deputy Assistant Secretary for International Affairs and the NMFS head; must consult the Senate Commerce, Science, and Transportation Committee and the House Committee on Resources on negotiations (including shellfish); may delegate duties to NOAA staff. Effective January 1, 2009.
