Title 16 › CHAPTER 1 — NATIONAL PARKS, MILITARY PARKS, MONUMENTS, AND SEASHORES › SUBCHAPTER I — NATIONAL PARK SERVICE › § 1a–7b
The Secretary must not make or enforce any rule that stops a person from having a firearm, including an assembled or working firearm, in any unit of the National Wildlife Refuge System if the person is not already banned by law from having a gun and if the gun possession follows the state law where the refuge is located. Congress found that the Second Amendment protects the right to keep and bear arms, and that 27.42 of title 50 generally banned firearms on national wildlife refuges except in special cases. Those rules kept law-abiding people from exercising their Second Amendment rights, and different rules at different refuges trapped gun owners. The Bush administration put new rules into effect on January 9, 2009; on March 19, 2009 a court issued a preliminary injunction against enforcing those rules; the rules were under review by the Obama administration and might be changed. Congress said it must act to protect rights on 90,790,000 acres managed by the Fish and Wildlife Service.
