Title 16 › Chapter 44A— ANTARCTIC MARINE LIVING RESOURCES CONVENTION › § 2432
Defines key words used in the chapter about Antarctic marine life and ships. Antarctic Convergence is the specific line made by joining a set of latitude and longitude points listed in the law. Antarctic marine living resources means populations of finfish, molluscs, crustaceans, and all other living species, including birds, found south of the Antarctic Convergence. Commission means the Commission for the Conservation of Antarctic Marine Living Resources created under article VII of the Convention. Convention means the Convention on the Conservation of Antarctic Marine Living Resources, done at Canberra on May 7, 1980, and effective for the United States on April 7, 1982. Harvesting or “harvesting or other associated activities” covers catching or harming animals, trying to do those things, any activity likely to lead to those things, and sea operations that support or prepare for them. Harvest means to carry out those activities. Import means landing, bringing into, or trying to bring into any place under U.S. control, whether or not customs calls it an import. Person means an individual, partnership, corporation, trust, association, or any other entity under U.S. jurisdiction. Scientific Committee means the Scientific Committee for the Conservation of Antarctic Marine Living Resources created under article XIV of the Convention. Vessel of the United States includes vessels documented or numbered under U.S. law; vessels owned in whole or part by the United States, a U.S. territory, a State, a U.S. citizen or national, or a U.S. corporation; and vessels that were once U.S.-documented but were illegally sold or placed under a foreign flag. Vessel subject to the jurisdiction of the United States also includes vessels without nationality or those treated as without nationality under paragraph (2) of Article 6 of the 1958 Convention on the High Seas.
